Fagain consulted Counsel and they advised that the question as to the legitimacy of Mathew Falconer could not be raised.

It was further contended by the Petitioners that "Mathew Falconer" never married and therefore Marion Falconer and Mathew Lawlor Falconer were not usually entitled to the Estate of Matthew Falconer deceased.

Solicitor on the other hand on behalf of H. E. Falconer stated that she had purchased from Mr Marion Falconer her estate and interest in the Estate of her husband Mathew Falconer deceased.

We consulted Counsel regarding the various statements of the Petitioners and it was arranged that Counsel should see William Saylor Falconer and his wife and advise them. This was done and Mrs. H. E. Falconer considered that she could get some evidence from America in support of the statement that Marion Falconer was not the wife of the said Mathew Falconer and she proposed to write to someone arranging for information. It was then decided that in the meantime proceedings should remain in abeyance.

A long time passed and finally Mrs. H. E. Falconer said she had not obtained any further information. I duly consulted Counsel and have asked Mr Robinson for his opinion and advice. I beg to enclose a copy of his opinion regarding the Estates of Mathew Falconer deceased and Mathew Lawlor Falconer.
